DIFC Guardianship Will

For clients looking to address only the guardianship of their minor children (under the age of 21) in the event of their death, the DIFC Guardianship Will is a recommended option as it is limited to the appointment of Guardians for minor children and does not include any instructions relating to the distribution of the testator’s assets.

As a non-Muslim expatriate in the UAE, you have the option of registering a DIFC Guardianship Will with the Dubai International Financial Centre (“DIFC”) which is enforceable in the Emirate of Dubai and/or Ras Al Khaimah. The DIFC Wills and Probate Registry (“WPR”) is a division of the Dispute Resolution Authority of the DIFC and is mandated with processing probate applications and processing of probate claims for all DIFC Wills.

In addition to various advantages of registering a DIFC Guardianship Will, the key benefits of registration with the DIFC WPR is that you, as the testator, have the right to choose the guardian without the risk of Shariah rules being applicable to your guardianship instructions. The DIFC Guardianship Will is enforceable without the need for further action through Dubai or Ras Al Khaimah Courts.

However, please note a DIFC Guardianship Will is exclusively limited to the guardianship of your children and does not address matters pertaining to any assets you may have in Dubai and/or Ras Al Khaimah. If this is of concern to you a full DIFC Will may be more suitable for you.

Registration Fee:

DIFC WPR Registration Fee for Single Guardianship Will – AED 5,000 per Will
DIFC WPR Registration Fee for Mirror Guardianship Wills – AED 7,500 per set

Note: Please note that the Wills Department’s professional fees do not include costs of registration of Wills with DIFC WPR. The costs of such disbursements are in addition to the Wills Department’s professional fees and payment of these disbursements is the client’s responsibility. Any assistance offered in obtaining related third-party services through the Wills Department in its capacity as a facilitator remains subject to terms and conditions as dictated by the relevant third party.

  • Testator must be a non-Muslim
  • Testator must be of at least 21 years of age
  • Please note to be eligible for the DIFC Guardianship Will the DIFC should be able to establish habitual residence (of the Children) in the Emirate of Dubai and/or Ras Al Khaimah.
